The Federated States of Micronesia has no comprehensive data-protection law in force. Existing privacy protections are limited to a single sector: Title 21 of the FSM Code obliges telecommunications providers to keep customer information confidential and obtain consent before any collection or disclosure. A draft Personal Data Protection Act of 2025, which would create a cross-sector regime covering national government data handling, was pending before FSM Congress as of late 2025.

FSM Code Title 21, §§349–350 require telecommunications providers to maintain the confidentiality of customer information and communications, prohibit collection, use, or disclosure without customer consent, and mandate appropriate security safeguards — the only binding sectoral privacy obligations currently in force.
A bill titled the Personal Data Protection Act of 2025 was introduced before the FSM Congress; if enacted it would regulate personal data handling by national government departments, marking FSM's first cross-sector data-protection instrument.
The FSM Constitution enshrines a right to privacy, but no implementing legislation translates this into data-subject rights, controller obligations, or enforcement mechanisms outside the telecom sector.
FSM has no data-protection authority or privacy regulator. DLA Piper's authority index for FSM is blank; the FSM Telecommunications Regulatory Authority has jurisdiction only over the telecom sector.
FSM's Cybersecurity Roadmap and a November 2024 Inaugural Cybersecurity Symposium identified enactment of a Personal Data Protection Act and a Cybercrime Act as priority reforms; a broader legal framework for digital government—including data privacy—was targeted for completion by 2026 but remains in development.
