Burkina Faso has no dedicated AI legislation in force as of mid-2026. The Ministry of Digital Transition, Postal and Electronic Communications launched a consultative national workshop in August 2025 to draft the country's first National AI Action Plan (2026-2028), which explicitly includes development of legal and ethical AI frameworks as one of its six pillars. In the interim, AI-adjacent issues are addressed through the 2021 personal data protection law and a 2024 cybersecurity law.

As of May 2026 Burkina Faso has enacted no comprehensive or sectoral AI law. The country relies on general data protection and cybersecurity legislation while its dedicated AI legal framework remains in the design phase.
In August 2025 the Ministry of Digital Transition convened a national situational analysis workshop to draft the first National AI Action Plan (2026-2028), structured around six pillars: infrastructure, data governance, human capital, legal/ethical frameworks, strategic use-cases in health/agriculture/education, and international cooperation.
Law No. 001-2021/AN of 30 March 2021 governs personal data processing and is administered by the Commission de l'Informatique et des Libertés (CIL), an independent authority established in 2004. The CIL has co-sponsored international resolutions on AI accountability and facial recognition technology, positioning it as the de-facto AI-adjacent regulator.
A cybersecurity law enacted in July 2024 reinforces the National Agency for Information Systems Security (ANSSI), which also operates the national CIRT. This law indirectly governs AI-enabled information systems in public administration and critical infrastructure.
In October 2024 Burkina Faso hosted a regional workshop in Ouagadougou to develop ethical, responsible, and inclusive AI guidelines for West Africa, reflecting its participation in regional norm-setting ahead of national legislation.
The transitional government frames AI within a broader digital sovereignty agenda; a March 2026 initiative integrates Burkina Faso's national languages into AI systems developed for public broadcasting and government services, supported by the Ministry of Digital Transition.
