The British Virgin Islands has enacted no AI-specific legislation, national AI strategy, or published government guidelines on artificial intelligence as of May 2026. General obligations under the Data Protection Act 2021 apply incidentally to AI systems that process personal data, and the FSC's fintech regulatory sandbox (2020) can accommodate AI-driven financial services innovation, but neither instrument constitutes an AI governance regime. Offshore law firms advise BVI-based entities to build voluntary AI governance frameworks in anticipation of future regulation.

The Data Protection Act 2021 (No. 3 of 2021), in force from July 2021, governs processing of personal data by public and private bodies and established the Office of the Information Commissioner. It applies incidentally to AI systems that process personal data but contains no AI-specific provisions.
The BVI Financial Services Commission launched the Financial Services (Regulatory Sandbox) Regulations 2020 to allow AI-enabled fintech business models to operate under a lighter-touch regime for up to 18 months (extendable by 6 months). This is innovation facilitation, not AI regulation.
The BVI government has not published a national AI strategy, ethics principles, or voluntary guidelines. Unlike larger Caribbean jurisdictions, the BVI has not participated in a published AI policy process of its own.
The Caribbean Telecommunications Union launched a Caribbean AI Task Force in July 2025 to develop harmonised regional AI governance recommendations, with a final report and Caribbean AI Forum planned for 2026. The BVI, as a UK Overseas Territory, is not a full CARICOM member and is not formally bound by this process.
The UK's Artificial Intelligence (Regulation) Bill is before Parliament but, as a proposed UK domestic measure, it does not automatically extend to British Overseas Territories such as the BVI unless expressly applied by Order in Council.
